End-User License Agreement

1. License Grant

Altricity grants you a limited, non-exclusive, non-transferable license to use the Licensed Materials solely with Altricity's hardware products and services, for your personal, non-commercial use. You may not modify, reverse engineer, sublicense, or distribute the Licensed Materials.

2. Usage Limitations

• You agree not to use the Application while operating a motor vehicle.
• You must follow all installation instructions provided.
• Altricity is not responsible for damage caused by improper installation, misuse, or use with incompatible third-party devices or batteries.

3. Connectivity & Functionality

The Application requires Bluetooth and/or cellular connectivity to operate as intended. Certain functions may be unavailable without active connection.

4. Data Collection

The Application collects data related to device operation, battery health, diagnostic status, and user interactions. By using the Application, you consent to Altricity collecting, storing, and using this data to improve the product and its features. Aggregated, non-identifiable data may be shared with third parties.

5. Disclaimer Warranty

THE LICENSED MATERIALS ARE PROVIDED “AS IS.” ALTRICITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTRICITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE LICENSED MATERIALS. TOTAL LIABILITY IS LIMITED TO $1.00.

7. Indemnity

You agree to indemnify and hold harmless Altricity and its officers, agents, and suppliers from any claims arising from your use of the Licensed Materials, including damage to your vehicle, injury, or legal claims by third parties.

8. Termination

This Agreement is effective until terminated. Altricity may terminate this Agreement if you fail to comply with its terms. Upon termination, you must stop using and delete all copies of the Application.

10. Governing Law

This Agreement shall be governed by the laws of the State of Arizona, without regard to its conflict of law principles. You agree to resolve any dispute exclusively in Maricopa County, Arizona.

11. Entire Agreement

This is the complete agreement between you and Altricity regarding the Application and supersedes all prior agreements.

12. Hardware-App Interface Warning

The Application interfaces with physical components installed in your vehicle. By using the Application, you acknowledge that certain actions (such as initiating a jump start) have real-world effects and should be used only under safe, supervised conditions. Altricity disclaims all responsibility for unintended use, accidental activation, or hardware damage caused by the user's operation of the app.

13. Edge Case Disclaimers

• Altricity is not responsible for any damage, injury, or loss arising from improper installation or failure to follow installation instructions.
• Use is limited to 12V automotive systems. Compatibility with non-standard vehicles is not supported.
• Performance may vary depending on battery condition. Altricity does not
  guarantee recovery from deeply discharged or damaged batteries.
• Use of the product in hazardous or non-standard environments is at your own risk.
• Firmware updates are provided as-is. Interrupting updates may impair product functionality.
• Functionality may be limited by your device’s system settings. Altricity is
  not responsible for inoperability due to denied permissions.
• The lockout entry feature is intended as a backup and may not work in all
  conditions. Users should maintain a physical means of access.
• Collected data is anonymized where possible and used for product support,
  warranty management, and product improvement only.
• Performance is not guaranteed in extreme environmental conditions outside rated temperature ranges.
